We hereby provide you with information regarding the processing of your personal data in connection with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”).

We have not appointed a Data Protection Officer.

What personal data do we process?

  • title, first name and surname, date of birth, personal identification number, tax identification number, residential address, registered office address, delivery address (hereinafter referred to as the “identification data”);
  • e-mail address, telephone number, fax number (hereinafter referred to as the “contact data”);
  • cookies and IP address (hereinafter referred to as the “non-identifiable data”)

    For how long and why do we process your personal data?
    We process personal data with or without your consent, depending on the purpose of the processing. If we enter into legal relations with a legal entity, we process the identification and contact data of the representative of the legal entity in the same manner as in the case of a natural person.

    Personal data processed with your consent
    Based on the consent granted, we process identification and contact data in order to:

  • send our offers in writing (by e-mail or post);
  • communicate our offers by telephone;
  • enable registered customers to make repeat purchases;

    For these purposes, we process identification and contact data until the consent is withdrawn.
    Based on the consent granted, we process non-identifiable data (when visiting the website) in order, in particular, to:

  • display the website correctly;
  • repair malfunctioning parts of the website;
  • monitor website traffic;
  • create website traffic statistics and reports and measure the effectiveness of advertising;

    For these purposes, we process non-identifiable data until the consent is withdrawn (consent is given through the browser settings allowing the website to store cookies on the end device). In general, we do not create individual profiles of online activities and do not associate the processed data with a specific person.

Personal data processed without your consent
Based on our legitimate interest, in connection with legal acts aimed at concluding a contract, we process identification and contact data in order, in particular, to:

  • communicate regarding the subject matter of the contractual relationship to be concluded;
  • record requests related to the contract to be concluded;
  • conclude the contract;
  • search for offers in cases where the same offer is to be submitted again for acceptance.

    For these purposes, we process identification and contact data for a period of 1 year from the expiry of the period for accepting the offer, or from the date of submission of the offer if no period is specified.
    On the basis of performance of the contract, we process identification and contact data for the purpose of:

  • exercising the rights and obligations arising from the contractual relationship;
  • communication regarding the performance of the concluded contract;
  • ensuring a partial part of the delivery in connection with the performance of the concluded contract (for example, transport);
  • payment identification;
  • handling requests (for example complaints).

    For these purposes, we process identification and contact data for a period of 3 years from the date of conclusion of the contract, or from the date of delivery of goods or services under the contract, whichever is later.
    Based on our legitimate interest, we process identification and contact data for the purpose of:

  • protecting our legal claims (in possible judicial or administrative proceedings);
  • maintaining internal records and carrying out internal control;

    For these purposes, we process identification data for the duration of the statutory objective limitation periods, i.e. 10 years and 1 year after their expiry, taking into account claims asserted at the end of the limitation period, or until the limitation of our claims, if the limitation period is suspended or interrupted during the above period.

For the purpose of fulfilling legal obligations, we process identification and contact data in order to comply with obligations arising from the following legal regulations:

  • Act No. 89/2012 Coll., Civil Code;
  • Act No. 634/1992 Coll., on Consumer Protection;
  • Act No. 235/2004 Coll., on Value Added Tax;
  • Act No. 563/1991 Coll., on Accounting;

    For these purposes, we process identification data for a period of 10 years from the termination of the legal relationship arising from the concluded contract, or until the completion of the relevant proceedings, if initiated within the above period and not concluded before its expiry.

    To whom do we disclose your personal data?
    In connection with the performance of the contract, we may disclose personal data to other entities involved in the performance of the concluded contract:

  • entities operating payment systems for the purpose of processing payments (banks and payment institutions);
  • entities providing transportation services (contract carriers);
  • our suppliers, where necessary for the performance of the concluded contract;

In connection with our legitimate interests and the fulfillment of legal obligations, we may disclose personal data to other entities, such as:

  • accountants, tax advisers and auditors (accounting and tax advisory services);
  • lawyers, notaries, collection agencies, court experts and interpreters (protection of our legal claims);
  • insurance companies (performance under insurance contracts);
  • cloud service providers;
  • suppliers and administrators of IT technologies and networks;
  • courts, public authorities and other governmental bodies;


    Non-identifiable data obtained on the basis of granted consent may be disclosed to the following entities:

    • advertising and social networks;
    • providers of advertising and marketing services;
    • suppliers and administrators of IT technologies and networks;

      As part of the transfer of data, we may also transfer your data to third countries outside the European Economic Area which ensure an adequate level of personal data protection, or where the recipient undertakes to comply with the standard contractual clauses issued by the European Commission (http://eur-lex.europa.eu/legal-content/en/TXT/uri=CELEX%3A32010D0087)

      From what sources do we obtain personal data?
      As a rule, we process personal data provided to us in connection with the conclusion of a contract or during communication with us.
      We may obtain additional information from banks or payment service providers, for example regarding the payment account number.

      In certain cases, we are entitled to obtain personal data from public registers, in particular in connection with our legitimate interests.

      What rights do you have regarding the processing of personal data?
      We are also obliged to inform you of your rights in connection with the processing of personal data. In all matters concerning the processing of your personal data, you may contact us at info@hz-kontejnery.cz. We will deal with your request without undue delay, no later than within one month. In exceptional cases, we are entitled to extend this period by a further two months, of which we will inform you if necessary.

  1. You have the right of access to personal data, i.e. the right to obtain information from us regarding (i) what personal data we process about you, (ii) for what purpose, (iii) for how long, (iv) where we obtain it, (v) to whom we disclose it, (vi) who processes it in addition to us, (vii) whether automated decision-making, including profiling, takes place, and (viii) what other rights you have in connection with such processing. You may request confirmation as to whether your personal data are being processed and, if so, you have the right to access such personal data. You may request a copy of the processed personal data; the first copy will be provided free of charge, further copies may be subject to a fee. In complying with your request, the rights and freedoms of other persons must not be adversely affected.
  2. You have the right to rectification or completion of personal data if you find that we process inaccurate or incomplete data;

You have the right to have your personal data erased without undue delay if one of the following reasons applies: (i) your personal data are no longer necessary for the purposes for which they were processed; (ii) you withdraw your consent and there is no other legal basis for processing; (iii) following your objection to processing based on our legitimate interests, we find that no overriding legitimate grounds exist; (iv) the processing of personal data is no longer in accordance with applicable legal regulations. This shall not apply where we need the personal data for the establishment, exercise or defence of legal claims.
  2. You have the right to restriction of processing of personal data, allowing you in certain cases to request that your personal data be marked and not processed for a limited period; we must comply where: (i) you contest the accuracy of the personal data; (ii) we process the data without sufficient legal basis, but you request restriction instead of erasure; (iii) we no longer need the data for the stated purposes, but you require them for the establishment, exercise or defence of legal claims; (iv) you object to the processing. During the period in which we investigate whether your objection is justified, we are obliged to restrict the processing of your personal data.
  3. You have the right to data portability, i.e. the right to obtain from us all personal data which you have provided to us and which we process on the basis of your consent or performance of a contract; we will provide them in a structured, commonly used and machine-readable format;
  4. You have the right to object to the processing of personal data carried out on the basis of our legitimate interest or where you have granted consent. We will cease processing unless we have compelling legitimate grounds for continuing such processing;
  5. You have the right to withdraw your consent to the processing of personal data at any time;
  6. You have the right to lodge a complaint with the competent supervisory authority. You may exercise this right particularly if you believe that we process your personal data unlawfully or contrary to generally binding legal regulations. You may lodge a complaint with the Office for Personal Data Protection (www.uoou.cz).
